A Gadsden man faces a rape charge after an assault was reported to Collinsville police, according to DeKalb County Sheriff Nick Welden.
Collinsville police contacted county investigators regarding the sexual assault and the subsequent investigation led to an arrest.
Jose Elisama Francisco-Diego, 21, of Gadsden, is charged with first-degree rape. He was booked into the DeKalb County Detention Center Dec. 29, and has been released on bond.
According to court documents, the charges stem from an assault on a female who was "incapable of consent by reason of being physically helpless or mentally incapacitated."
“The DeKalb County Sheriff’s Office takes these types of cases very seriously,” Welden said in a press release.
“Citizens in DeKalb County and surrounding counties should know that crimes of this nature and others will not be tolerated in this county.
