MOVING ON: Rainsville Sues Chavies Bridge Property Owner Holdouts

RAINSVILLE, Ala. — In a special called meeting, the Rainsville City Council moved to authorize City Attorney Nikki Scott  to file a lawsuit against the property owners adjacent to the Chavies Bridges in order to condemn two tracts of property.

Scott updated the council that all right-of-way negotiations were settled with the exception of two tracts. The two tracts in questions are owned by Roger and Teresa Berry.

Without the purchase of these two tracts, “the City was sitting on dead center” Scott stated. She also informed the council, that Mr. Berry had obtained a lawyer and that she had been in talks with the lawyer, since September 12, 2017.

The City had offered the Berry’s a price that was set by a contracted right-of-way acquisition specialist.  A response to the city’s offer was due by October 13, 2017.  Scott advised the Council that it would be in the City’s best interest to move forward with a process to condemn the property.

“All we can do is move on,” said Mayor Rodger Lingerfelt. After a brief discussion on alternative means to settle this, the Council voted to move forward with the condemnation process.

    Help me here. The city could not reach a sales agreement with the property owner...so they just opt to condemn the property and take it?

    That awesome update of phones and Data service for inmates for county jail !!!! And I barely can afford mine ! But inmates are getting updates, with our tax 💰.
